2. The petitioner seeks regular bail in connection with Madhuban P.S. Case No. 475 of 2023 lodged on 25.09.2023 under Sections 147, 148, 149, 341, 323, 324, 307, 325, 379, 504 and 506 of the Indian Penal Code.

3. As per the prosecution case, the FIR has been lodged against eight named accused persons, including the present petitioner alleging therein that the petitioner has assaulted on the head and hand of the informant with a farsa.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. In fact, the informant and the petitioner are agnates and in the background

As per the prosecution, the petitioner is alleged to have assaulted the informant by means of a farsa, but the injury report annexed as Annexure -3 suggests that the injuries are simple in nature and caused by the hard and blunt substance. The petitioner is in custody since 24.12.2023 and is accused in one more criminal case, in which the final form has been submitted.

5. Learned counsel for the State opposes the prayer for bail.

In the present facts and circumstances of this case and the submissions made above, let the petitioner above named be granted bail on furnishing bail bonds of Rs.30,000/- (Rupees Thirty thousand) with two sureties of the like amount each to the satisfaction of learned CJM, East Champaran, Motihari, subject to the conditions as laid down under Section 437(3) of the Code of Criminal Procedure.
