The petitioner seeks regular bail in connection with Budha Colony P.S. Case No. 320 of 2015 registered for the offences punishable under Sections 419, 420, 467, 468 and 471/34 of the Indian Penal Code.
The above P.S. Case No. 320 of 2015 was registered on the basis of written report of Special Executive Officer, Central Selection Council (appointment of constable) addressed to the Senior Superintendent of Police. The petitioner was selected candidate for Patna District Police Force as per advertisement No. 0114. This petitioner was directed to appear before the Board on 29.11.2015 but he neither appeared before the Board nor any information was given. The informant raised suspicion of impersonation in getting the result of written test.
Patna High Court Cr.Misc. No.46891 of 2017 (2) dt.21-09-2017 2/2 The learned counsel for the petitioner submits that the petitioner appeared at the written test and physical examination. After verification, he was appointed as constable. He was neither noticed nor any information was given and he was arrested by the police while he was on duty at Hathidah. The allegation of impersonation, committing fraud, forgery and cheating is vague and without giving any show cause, the present case has been lodged. The petitioner is in custody since 19.07.2017, having clean antecedent and he also deserves to be enlarged on bail.
The learned APP for the State opposed the submission.
Considering the nature of allegation, facts and circumstances of the case, the prayer of bail is allowed. The petitioner, named above, is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Patna in connection with Budha Colony P.S. Case No. 320 of 2015.
