JUSTICE ASHWANI KUMAR SINGH ORAL JUDGMENT Date : 16-04-2019 It is submitted by the learned counsel for the petitioner that an application has been filed on 26.04.2018 in the court of learned Additional Chief Judicial Magistrate-IX, Bhojpur at Ara in Trial No. 1879 of 2017 arising out of Piro P.S. Case No. 39 of 2008 for release of Rs.2,64,000/- which was deposited in pursuance of the order dated 12.10.2011 passed in Cr. Misc. No. 6935 of 2011, but the application has not been disposed of till date.

2. Considering the nature of the prayer, the application is disposed of directing the learned Additional Chief Judicial Magistrate-IX, Bhojpur at Ara to dispose of the aforesaid application dated 26.04.2018 within 30 days from the date of receipt/production of a copy of the order.

3. It is made clear that this Court has not examined the case of the petitioner on merit.

4. The learned Additional Chief Judicial Magistrate shall be at liberty to pass order on the application of the petitioner in accordance of law without being influenced by the order passed in the present case.
