The Petitioner seeks bail in Kotwali (Tilkamanjhi) P.S. Case No. 342 of 2016 corresponding to G.R. No. 2421 of 2016 registered for the offence punishable under Sections 379, 511 of the Indian Penal Code and Section 25(1-b)a/26/27/35 of the Arms Act.

The informant has alleged that in the night of 21.07.2016, while he was loading the truck bearing no. BR-10H9992 saw a person who was coming down from the truck with stolen bucket of mobile and on raising alarm two persons fled away. Co-accused Vikash Kumar Yadav was arrested at the spot

Patna High Court Cr.Misc. No.33126 of 2017 (2) dt.20-07-2017 2/2 and on his confession two other persons who had fled from the spot were arrested.

It has been submitted on behalf of the petitioner that the petitioner is in custody since, 16.08.2016 and has got no criminal antecedent. It has further been submitted that similarly situated co-accused persons Kanhaiya Yadav and Vikash Kumar Yadav, have been granted bail vide order dated 13.12.2016 in Criminal Miscellaneous No. 49412 of 2016 and order dated 24.03.2017 in Criminal Miscellaneous No. 13927 of 2017. Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bonds of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhagalpur in connection with Kotwali (Tilkamanjhi) P.S. Case No. 342 of 2016 (G.R. No. 2421 of 2016).
