The petitioner is apprehending his arrest in connection with Bakhtiarpur P.S. Case No.162 of 2014 for allegedly having committed the offences under Sections 302, 307 and other allied Sections of the Indian Penal Code Learned counsel for the petitioner submits that the name of this petitioner has been falsely included in the present case and that even if the allegation is taken as true in toto, the petitioner can be treated to be a member of the mob. Learned counsel further submits that there is no specific allegation against the petitioner in the F.I.R..

Considering the aforementioned facts and

Patna High Court Cr.Misc. No.20155 of 2015 (2) dt.23-07-2015 2/2 circumstances and also the fact that the petitioner has no criminal antecedents, let the above named petitioner, in the event of his arrest or surrender before the court below within a period of three weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Saharsa, in connection with Bakhtiarpur P.S. Case No.162 of 2014, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
