The petitioner seeks regular bail in connection with Triveniganj P.S. Case No. 316 of 2017 for the offences punishable under Sections 341, 323, 326, 307/34, 302 of the Indian Penal Code and Section 27 of the Arms Act.

Allegation is regarding the maternal grand son of the informant having gone to the fair where altercation had taken place with other persons. When the said maternal grand son of the informant was returning back to the village, the accused persons surrounded him and one co-accused namely Ashish Yadav had fired on victim leading to his death subsequently in the hospital. The learned counsel for the petitioner submits that as far as the petitioner is concerned, neither there is any allegation

Patna High Court Cr.Misc. No.28558 of 2018 (2) dt.09-05-2018 2/2 against him of firing on the victim nor he is said to have been present at the place of occurrence nor anybody has taken his name. It is further submitted that the petitioner is languishing in custody since 11.10.2017.

Having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned A.C.J.M. Ist, Supaul in connection with Triveniganj P.S. Case No. 316 of 2017 GR-2138 of 2017.
