2. The petitioner seeks regular bail in connection with Jamo Bazar P.S. Case No. 10 of 2020 lodged on 02.02.2020, for the offence punishable under Sections 304(B), 328, 201 & 34 of the Indian Penal Code.

3. Learned counsel for the petitioner submits that the bail application of the petitioner has earlier been rejected vide order dated 19.03.2024 passed in Cr. Misc. No. 82957 of 2023 with liberty granted to the petitioner to renew his prayer for bail six months after framing of charge, if trial shall not be concluded within the said period. Counsel submits that the petitioner is in custody since 07.12.2022, having clean antecedent. Counsel further submits that on earlier occasion,

Patna High Court CR. MISC. No.15377 of 2025(4) dt.18-07-2025 2/2 report with regard to present stage of trial has been called for and upon perusal of the said report dated 20.05.2025, it transpires that the present case was committed to the Sessions Court on 22.09.2022 and transferred to the court on 21.07.2023. It also transpires from the report that one witness has been examined on 18.11.2024 out of five witnesses.

4. Learned APP for the State opposes the prayer for bail of the petitioner and submits that only one witness has been examined and four witnesses are yet to be examined.

5. In the present facts and circumstances of this case, let the above named petitioner be granted bail, on furnishing bail bond of Rs.30,000/- (Rupees Thirty Thousand) as mentioned in Section 2(1)(d) of the B.N.S.S., 2023 to the satisfaction of A.C.J.M., Siwan, in connection with Jamo Bazar P.S. Case No. 10 of 2020, subject to the conditions as laid down U/s 480(3) of the B.N.S.S., 2023.
