JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 10-08-2017 Heard learned counsel for the petitioner and the State. The petitioner is in custody in connection with Forbesganj P.S. Case No. 263 of 2017 for the offence under Sections 399 and 402 of the Indian Penal Code and Sections 25(1b) a /26/35 of the Arms Act. Allegation against the petitioner is that he is among the miscreants apprehended by the police allegedly on the ground for preparing to commit dacoity.

Learned counsel submits that similar circumstanced co-accused, namely, Sintu Kumar and Ranjan Singh, have been granted bail by this Court in Cr. Misc. No. 33153 of 2017 vide order dated 20.07.2017. The petitioner is in custody since 20.04.2017.

Considering the fact that the similar circumstanced

No. 33153 of 2017 vide order dated 20.07.2017, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Araria in connection with Forbesganj P.S. Case No. 263 of 2017, subject to the condition that the petitioner will extend full cooperation in conclusion of the trial and will not, in any manner, tamper with the evidence and influence the witnesses.
