JUSTICE ARUN KUMAR ORAL ORDER 27-04-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody since 14.3.2018, seeks bail in Pratapganj PS Case No. 36 of 2018 registered under Sections 467, 468 of the IPC, Section 63, 65 of Copy Right Act and Sections 103, 104 of Indian Trade Mark Act.

The allegation in brief is that petitioner is suspected to be engaged in selling spurious Dabur pudina.

Learned Counsel for the petitioner submits that the petitioner is retail shopkeeper, the informant is also employee of Dabur India Limited, seized article has been sent to Dabur India for analysis and not to any government independent agency.

Having considered the said facts and circumstances, the petitioner, namely, Bhola Razak is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of SDJM Birpur (Supaul) in connection with Pratapganj PS Case No. 36 of 2018.
