The petitioner apprehends his arrest in a case registered for the offence under Section 420, 465, 468, 471/34 of the Indian Penal Code.

As per the prosecution case, the petitioner, who is alleged to be Nepali citizen, after solemnizing marriage with Ranjana Devi of Sitamarhi district got his name recorded in the voter list and thereafter, prepared Aadhar Card from India. It is submitted on behalf of petitioner that petitioner has been falsely implicated in this case due to family dispute. Informant is none else but nephew of father-in-law of petitioner and he has greedy eye on the property of father-in-law of petitioner and as such, he deliberately filed the present case against petitioner and his wife. Patna High Court CR. MISC. No.16073 of 2022(2) dt.25-08-2022 2/2 case, petitioner has instituted Sursand P.S. Case No. 153 of 2015 against this informant and in retaliation, the informant has lodged present case. It is further submitted that wife of petitioner has already been granted anticipatory bail by the court below itself. Petitioner has got clean antecedent. Learned A.P.P. for the State has opposed the bail petition.

Considering the aforesaid facts and circumstances, let the above named petitioner, in the event of his arrest/surrender within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st Class, Pupari, Sitamarhi in connection with Sursand P.S. Case No. 6 of 2016, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
