Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner apprehends his arrest in connection with Rishiyap P.S. Case No. 61/2020 registered for the offences punishable under Sections 135 of the Electricity Act. Learned counsel for the petitioner submits that he is ready to deposit the theft amount of Rs. 3,60,145.00 (Rupees Three Lakhs Sixty Thousand One Hundred Forty-five) only. Considering the submission of learned counsel for the petitioner, the present anticipatory bail application is allowed.

No.26085 of 2021(4) dt.07-04-2022 2/2 Accordingly, let the petitioner above named be released on provisional bail, in the event of his arrest or surrender before the court below within a period of four weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Electricity, Magadh Area, Gaya, in connection with Rishiyap P.S. Case No. 61/2020, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C. and also subject to the condition that he will deposit the entire theft amount of Rs. Rs. 3,60,145.00 in six equal installments payable in six months.

It is directed that the petitioner shall be released on provisional bail if the petitioner surrenders and shows the receipt of deposit of first installment with the electricity company and after the final payment of six installments i.e., Rs. 3,60,145.00 in total, the bail bond of the petitioner shall be confirmed.
