Petitioner seeks bail in a case registered for the offences punishable under Sections 420,409,467,468,471,120-B of the Indian Penal Code.

Allegation is that the petitioner was Junior Engineer in the matter of scheme of construction of road which was assigned to co-accused Mahendra Kumar Singh, Assistant Engineer. A fake bill was produced by the accused persons including the petitioner without performance of work and this fact was noticed on inquiry by the informant. Thereafter, the work was assigned to some other persons.

Submission is that the petitioner has got not criminal

Patna High Court Cr.Misc. No.27415 of 2018(2) dt.07-05-2018 2/2 antecedent and no money was transferred to anyone against the work performed by the petitioner. Petitioner is in custody since 14.03.2018.

Considering the entire facts, let the petitioner, above named, be released on regular bail after completion of investigation and on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Barbigha Police Station Case No. 37 of 2017, subject to the condition that the petitioner shall fully cooperate with the investigation and trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
