This is an application for grant of regular bail filed on behalf of the petitioner. Petitioner is in custody in connection with Khiri More PS Case No. 01 of 2019 for the alleged offence punishable under Sections 427/436 of the Indian Penal Code and Section 17 of CLA Act.

In the instant case FIR was lodged against unknown. Petitioner was subsequently made an accused in the case. Learned counsel representing the petitioner submits that from the forwarding report of the police it would appear that petitioner is 75 years of old. He further submits that petitioner was apprehended on 18.01.2019 and since then he is in jail

Considering the fact that petitioner has not been convicted in any criminal case and is 75 years of old as also the fact that initially the case was lodged against unknown, petitioner deserves bail.

This application is allowed accordingly. Let the petitioner above named be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of ACJM -III, Danapur in connection with Khiri More PS Case No. 01 of 2019.
