JUSTICE ARUN KUMAR ORAL ORDER 27-04-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody since 5.3.2018, seeks bail in Darbhanga Sadar (Bhalpatti O.P.) PS Case No. 359 of 2017 registered under Sections 324, 326, 307, 504, 506 of the IPC and Section 27 of the Arms Act.

The allegation in brief is that a day prior to the occurrence the petitioner had abused the informant on mobile, when he went to the petitioner's shop and enquired then he shot at the informant causing fire arm injury in his chest.

Learned Counsel for the petitioner submits that it is not that the petitioner went to informant's place and caused injury and the allegation also appears absurd.

However, learned Counsel for the State submits that there is specific allegation against the petitioner of shooting on the chest of the informant and corresponding injury was also found on the person of the informant.

Having considered the specific accusation of serious nurture against the petitioner the Court is not persuaded to grant him bail. The prayer for bail is rejected.
