Heard learned counsel for the petitioner and learned counsel for the State through virtual court proceeding. In this case, the petitioner is seeking regular bail in connection with Rail (Jehanabad) P.S. Case No.92 of 2019 registered for offence punishable under section 395 of the Indian Penal Code.

As per allegation, while the informant was travelling in Patna-Hatiya Express, some unknown miscreants snatched his mobile bearing no. 7870777123 and 7903026225 and fled away. It is stated that the said mobile was recovered from one

Patna High Court CR. MISC. No.14140 of 2020(3) dt.12-06-2020 2/3 Soni Kumari who has disclosed the name of the petitioner and stated that she has purchased the said mobile from the petitioner in Rs.3500/-.

The learned counsel for the petitioner submits that the petitioner has no criminal history as well as his name has transpired during investigation by way of confessional statement of one Md. Jahid who has been granted bail by learned Additional Sessions Judge, Gaya in B.P. No. 2287/19/185/2019, inasmuch as the petitioner has remained in jail since 19.10.2019. Looking to the facts and circumstance of the case, the petitioner is directed to be enlarged on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of Judicial Railway Magistrate, Gaya in connection with Rail (Jehanabad) P.S. Case No.92 of 2019, subject to the condition that one of the bailors of the petitioner shall be his father/mother/brother/sister/wife. The petitioner will not induce any witness or tamper with the evidence.

The petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court. If the petitioner is found involved in similar type of allegation in future, the prosecution will have liberty to file an application for cancellation of his bail bond.
