JUSTICE DINESH KUMAR SINGH ORAL ORDER 03-05-2016 Heard learned counsels for the petitioners and the State. The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 302/34 of the Indian Penal Code and under Section 27 of the Arms Act. The prosecution case is that on 27.10.2014 at 6 P.M. the informant's brother Guput Singh went in the company of Sunil Singh and Sanjay Singh thereafter he did not return. Subsequently, someone informed the informant through mobile that his brother has been killed.

It is submitted by the learned counsel for the petitioners that the police was not arresting the accused persons the informant filed protest petition wherein petitioners have been

Patna High Court Cr.Misc. No.17900 of 2016 (3) dt.03-05-2016 2/2 cited as witnesses thereafter the police on 09.11.2015 maliciously made request for issuance of warrant of arrest against the petitioners. Statement has been in paragraph 3 of the petition that the petitioners have no criminal antecedent.

Considering the aforesaid facts, let the above named petitioners be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned SDJM, Rohtas at Sasaram in connection with Sanjhauli P.S. Case No. 69 of 2014 subject to the conditions as laid down under Section 438(2) Cr.P.C.

The bail bonds of the petitioners will be accepted on filing of an affidavit by the petitioners before the court below that they will regularly cooperate in the investigation. The said affidavit will be transmitted by the learned court below to the concerned I.O. Non cooperation in the investigation will give liberty to the prosecution to file application before the learned court below to cancel bail bonds of the petitioners. BKS/- (Dinesh Kumar Singh, J) U T
