The petitioner seeks bail in a case registered under Sections-435, 307/34 of the Indian Penal Code and 27 of the Arms Act.

Prosecution case in short is that the tractor of the informant was set ablazed. It is also alleged that the firing was also made by the accused persons.

It is submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner has falsely been implicated in the present case. The petitioner is in custody since 29-11-2022. The petitioner has already remained in custody for about five months. The charge

The petitioner is said to have been injured in course of the occurrence. No offence under Section-307 of the Indian Penal Code is made out. General and omnibus allegation has been made against the petitioner.

Learned counsel for the State submits that the petitioner is named in the FIR.

Considering the aforesaid facts and circumstances, let the petitioner named above, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Court below/concerned Court in connection with Athmalgola P.S. Case No. 311 of 2022.
