JUSTICE DINESH KUMAR SINGH ORAL ORDER 13-07-2015 Heard learned counsels for the petitioner and the State. The petitioners being the mother and sister of the husband of the victim are apprehending arrest in a case registered for the offences punishable under Sections 498A and 306/34 of the Indian Penal Code.

It is alleged that due to cruelty inflicted, the informant set herself on fire by poring kerosene oil, subsequently the informant succumbed to the injury.

It is submitted by learned counsel for the petitioners that since the informant has illicit relationship with someone else which was protested by her husband, hence the victim committed suicide. The investigation against the petitioners is pending when the husband of the victim has been chargesheeted but during trial all the

Patna High Court Cr.Misc. No.23137 of 2015 (2) dt.13-07-2015 2/2 witnesses have become hostile and not supported the accusation. The aforesaid facts constitute good ground for consideration of prayer for regular bail.

Let the learned court below consider the prayer for regular bail of the petitioners if they surrender within a period of six weeks in connection with Thawe P.S. Case No. 144 of 2013 pending in the court of learned CJM, Gopalganj. Accordingly, the application is disposed of.
