Petitioner seeks bail in a case registered under Sections 400, 401, 413, 414, 420, 467, 468, 471, 120B/34 of Indian Penal Code.

It is submitted on behalf of the petitioner that one Deepak Kumar has been arrested in the instant case along with the stolen motorcycle. It is further submitted that on the basis of the disclosure made by the said Deepak Kumar, the petitioner has falsely been implicated in this case. It is also submitted that the petitioner has mobile phone shop and he has been arrested from there and nothing has been recovered from his possession. Prior

Patna High Court Cr.Misc. No.33291 of 2017 (2) dt.20-07-2017 2/2 to the instant case, there is no criminal antecedent against the petitioner that he is in custody since 05.02.2017. Counsel for the petitioner has placed on record order dated 21.06.2017 passed in Cr Misc No 22061 of 2017 and other analogous cases whereby this Court has granted bail to other co-accused persons. In the light of the aforesaid submissions, prayer for bail of the petitioner is allowed. Let the petitioner above named be released on bail on his furnishing bonds of Rs 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Sub Divisional Judicial Magistrate, Darbhanga in Bahadurpur Police Station Case No 45 of 2017 subject to the condition that both the bailors should be local residents of the territorial jurisdiction of the Court below.
