JUSTICE VINOD KUMAR SINHA ORAL ORDER 07-03-2019 This is an application for grant of anticipatory bail in connection with Gaya Sadar Kotwali P.S. Case No. 580 of 2018, disclosing offences under Sections 420 and 406 of the Indian Penal Code.

Allegation against the petitioner is that he has cheated the informant by taking Rs.5,00,000/- in advance and also Rs.10,000/- for giving possession of the shop. Submission of learned counsel for the petitioner is that he is only a shop owner of the shop of Waqf Board and he is not competent to make any agreement and moreover the case is of civil dispute and a title suit is going on with respect to the shop.

Heard learned A.P.P. as well as learned counsel for the

Patna High Court CR. MISC. No.14234 of 2019(2) dt.07-03-2019 2/2 informant, who opposed the prayer for anticipatory bail of the petitioner.

Having heard both sides, considering the above submission, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Gaya, in connection with Gaya Sadar Kotwali P.S. Case No. 580 of 2018, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure. (Vinod Kumar Sinha, J) Amjad/- U T
