2. The petitioner is in custody in connection with Muffasil (Banuchhapar) P.S Case No. 155 of 2023 registered for the offences punishable under Sections 363, 365 of the I.P.C and lateron Section 363, 365, 302, 201/34 I.P.C.

3. As per prosecution case, it is a case of abduction and killing of informant's son.

4. Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case. It is further submitted that petitioner is not named in FIR whereas his name surfaced from the confessional statement of the co-accused. It is next submitted that co-accused has already granted bail by the

Patna High Court CR. MISC. No.21698 of 2024(3) dt.19-04-2024 2/2 Co-ordinate Bench of this Court vide order dated 07.02.2024 passed in Cr. Misc. No. 68555 of 2023 and order dated 27.03.2024 passed in Cr. Misc. No. 19780 of 2024. Petitioner has got no criminal antecedent as stated in para 3 of the bail petition. It is also submitted that petitioner is in judicial custody since 06.03.2023.

5. However, learned APP for the State oppose the prayer for regular bail of the petitioner.

6. On perusal of the FIR, impugned order and period of custody and also considering the aforesaid facts and circumstances of the case and submissions made on behalf of the petitioner, let the above named petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bettiah, West Champaran in connection with Muffasil (Banuchhapar) P.S Case No. 155 of 2023.
