JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 06-05-2022 Heard learned counsel for the petitioner and the State. Petitioner seeks regular bail in a case registered for the offence punishable under Section 30(a) of the Bihar Prohibition and Excise Act and section 272 of the IPC .

As per the prosecution case, 28.300 liters of liquor was recovered from the shop of the petitioner. Learned counsel appearing for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. No incriminating material has been recovered from the conscious possession of the petitioner and he is no way concerned with the alleged recovery as the shop in question does not belong to him. District & Session Judge-cum-Special Judge Excise, Barh, District - Patna in connection with Bakhtiyarpur Police Station Case No. 286 of 2021, corresponding to Special Case No. 8452 of 2021.
