Petitioner seeks regular bail in connection with Ara Town PS Case No. 221/2021 registered for the offence punishable under Sections 326/307/506/34 of the IPC and under Section 27 of the Arms Act. .

As per First Information Report, co-accused persons, namely, Prince Kumar and Vipul called the son of the informant and pointed pistol upon him and further allegation against the petitioner is that he told the informant's son to leave the place or he will be shot dead.

Learned counsel for the petitioner submits that the only allegation against the petitioner is that he told the informant's son that if he would not leave the place of occurrence, he would be killed. In the second part of allegation the FIR is

Learned counsel further submits the petitioner having no criminal antecedent is in custody since 18.08.2021. The charge-sheet has been submitted and there is no likelihood that the petitioner will abscond or tamper with the evidences.

Having regards to the submissions made by the parties and taking into consideration the material on record and the fact that the petitioner having no criminal antecedent is in custody since 18.08.2021, the charge-sheet has been submitted and there is no likelihood that the petitioner will abscond or tamper with the evidences, I am inclined to grant regular bail to the petitioner.

Accordingly, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhojpur at Ara in connection with Ara Town PS Case No. 221/2021.
