JUSTICE DINESH KUMAR SINGH ORAL ORDER 24-04-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 341,323,504 and 420/34 of the Indian Penal Code.
It is alleged that the informant went to ask for the wages of centering work when he was abused by the petitioner and her husband by calling the caste name. When the informant made protest, he was assaulted by fists and slaps. Specific accusation of pushing the informant by pressing his neck is against co accused Bijay Thakur when Praveen Kumar alias Guddu came to save the informant then he was also being assaulted.
It is submitted by the learned counsel for the petitioner that Praveen Kumar has lodged Mansoorchak P.S. Case No.19 of
Patna High Court Cr.Misc. No.11464 of 2015 (2) dt.24-04-2015 2/2 2013 making accusation under sections 341,323,379 and 307/34 IPC for the same incident but the petitioner was not named though her name subsequently sprang up during investigation and the petitioner has been granted anticipatory bail in the connected case vide Cr. Misc. No. 10609 of 2015.
Considering the fact that the accusation has been levelled in the background of wages dispute and accusation is not specific against the petitioner when in the connected case lodged for the same incident the petitioner, who is lady, has been granted anticipatory bail, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Begusarai in connection with Begusarai SC/ST P.S. Case No. 35 of 2013 subject to the conditions as laid down under Section 438(2) Cr.P.C.
