The petitioner seeks bail in a case registered for offences under Sections 272 and 273 of the Indian Penal Code and Section 30 (a) of the Bihar Prohibition and Excise Act, 2016.

It is contended that, as per allegation, 465 litres of Nepali Soufi wine were allegedly recovered from the bamboo clamp and on the basis of confessional statement of co-accused Sanjay Prasad and Jatan Sah the petitioner has been implicated in this case, however, the petitioner is accused in one other case, i.e., Chhatauni P.S. Case No. 37 of 2005 for offences under

Patna High Court Cr.Misc. No.40399 of 2017(2) dt.25-08-2017 2/2 Sections 363, 365, 371 and 302 of the Indian Penal Code. It is further contended that the petitioner is in custody since 24.04.2017.

Considering the facts and the circumstances of the case, the petitioner, above named is directed to be released on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional District & Sessions Judge-VIIcum-Special Judge, Excise Act, East Champaran, Motihari in connection with Motihari Mufassil P.S. Case No. 157 of 2017 with a condition that if the petitioner, after his release in this case, is again found to be involved in criminal case of similar nature, the court concerned would be at liberty to take steps for cancellation of his bail bonds.
