It has been submitted by learned counsel for the appellant in para 3 of the order dated 18.09.2017, it has inadvertently been mentioned as "witnesses have stated that appellant was seen going with the deceased" however the same should have been that no specific overt act has been attributed to the appellant and further the date of period of custody has also inadvertently been mentioned as 13.07.2017, whereas, it should have been 31.07.2017.

In such view of the matter para -3 of the order dated 18.09.2017 be modified to the extent that the sentence "witnesses

Patna High Court CR. APP (SJ) No.2539 of 2017 (4) dt.22-09-2017 2/2 have stated that appellant was seen going with the deceased" be replaced with the sentence that no specific over act has been levelled to the appellant and further period of custody be also read as 31.07.2017 in stead of 13.07.2017.
