The petitioner seeks bail in Industrial Area (Hajipur) P.S. Case No. 31 of 2007 registered under Section 363, 364 & 366 of the Indian Penal Code.

As per the prosecution case, petitioner is said to have kidnapped the minor daughter of the informant enticing her. It is submitted by learned counsel for the petitioner that the victim in her statement recorded under Section 164 Cr.P.C. had herself stated that he has performed marriage with the petitioner out of her sweet will and the learned Magistrate has assessed the age of the victim as 18 years. Thus, the victim is major. The learned Magistrate at the instance of the father of the petitioner ordered to release the victim finding her major. The

Considering the facts aforesaid, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate 1st Class, Vaishali at Hajipur, in connection with Industrial Area (Hajipur) P.S.
