JUSTICE BIRENDRA KUMAR ORAL ORDER 07-05-2018 Heard learned counsel for the petitioner and learned APP for the State.

Petitioner seeks bail in a case registered for the offences punishable under Sections 399, 402, 412, 414 of the Indian Penal Code and Sections 25(1-B)A, 26, 35 of the Arms Act.

Allegation is that a country-made pistol was recovered from possession of the petitioner. Petitioner is in custody since 21.01.2018.

Submission is that co-accused, namely, Bipin Kumar, having similar allegation, has already been allowed bail by a Coordinate Bench of this Court vide order dated 03.05.2018 passed in Cr. Misc. No. 25135 of 2018.

Considering the nature of allegation against the

Patna High Court Cr.Misc. No.27206 of 2018 (2) dt.07-05-2018 2/2 petitioner, let the petitioner, above named, be released on bail on completion of nine months of custody on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Karja Police Station Case No. 11 of 2018, subject to the condition that the petitioner shall fully cooperate with the investigation and trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
