JUSTICE MADHURESH PRASAD ORAL ORDER 19-08-2017 Heard learned counsel for the petitioner and the State. Petitioner seeks bail in a case registered for offence under sections 15, 18 and 20 of the NDPS Act.

The case of the informant, a police officer, is that pursuant to some information, police party searched a parked truck and recovered a plastic packet from its cabin containing Doda powder. On the disclosure of Driver and Khalasi of the vehicle, petitioner was arrested on chase as a person who allegedly sold the narcotic substance to the said two persons. Learned counsel for the petitioner submits that the petitioner was not apprehended at the spot nor anything was recovered from his possession. Further, no case is pending against him prior to this case and he is in custody since 30.5.2017. Learned counsel also submits that the charge sheet

Considering the facts of the case, let the petitioner, as mentioned above, be released on bail on his furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of the Sessions Judge, Gaya (NDPS Act) in Barachatty Police station Case No. 316 of 2017.
