The petitioner seeks regular bail in connection with Kudra P.S. Case No. 337 of 2018, registered for the offence punishable under Sections 379 of the Indian Penal Code. The allegation is that the informant is stated to have parked his vehicle near his rented house in the night and in the morning, he found that the vehicle had been stolen. The learned counsel for the petitioner submits that as far as the present case is concerned, no recovery has been made from the conscious possession of the petitioner. It is further submitted that the petitioner has been falsely implicated in the present case after he was caught in connection with one another case bearing Pannuganj P.S.
Patna High Court CR. MISC. No.14895 of 2019(2) dt.11-03-2019 2/2 Case No. 66 of 2018. The learned counsel for the petitioner has submitted that though the petitioner was taken in custody on 15.08.2018, however, he has been remanded in the present case on 25.01.2019.
Having regard to the facts and circumstances of the case, I deem it fit and proper to enlarge the petitioner on regular bail.
Accordingly, the above named petitioner is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Kaimur at Bhabhua in connection with Kudra P.S.
