The petitioner is apprehending her arrest in connection with Kateya P.S. Case No.96 of 2008 for allegedly having committed the offence under Section 302/34 of the Indian Penal Code.
Learned counsel for the petitioner submits that the petitioner is not named in the F.I.R., but merely on the basis of suspicion and on account of the fact that one Hasmat Mian alias Haidar has been suspected to be the accused and she is the mother of said Hasmat Mian alias Haidar, the name of the petitioner has been brought in the present case. Considering the nature of the allegations made out in
Patna High Court Cr.Misc. No.20013 of 2015 (2) dt.25-06-2015 2/2 the F.I.R. and, admittedly, there was no eye-witness to the occurrence and also the fact that the petitioner has got clean antecedents, let the above named petitioner, in the event of her arrest or surrender before the court below within a period of three weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Gopalganj, in connection with Kateya P.S. Case No.96 of 2008, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. (Anjana Mishra, J) PNM U T
