JUSTICE BIRENDRA PRASAD VERMA ORAL ORDER 12-04-2016 After some argument, the learned counsel appearing on behalf of the petitioner, in presence of the learned Additional Public Prosecutor, appearing on behalf of the State, seeks permission to withdraw the present anticipatory bail application with a liberty to surrender in the court below within a period of four weeks from today and apply for regular bail. Permission is accorded.

The prayer for anticipatory bail made on behalf of the petitioner in connection with Danapur P.S. Case No. 270 of 2015, pending in the Court of learned A.C.J.M. Danapur, stands rejected as withdrawn with the liberty aforesaid.

It goes without saying that if the petitioner surrenders in the court below within the aforesaid period of four weeks and applies for regular bail, then the same shall be considered and decided on its own merit without being prejudiced by the fact that his prayer for anticipatory bail has been dismissed as withdrawn by this Court.
