2. The petitioner has approached this Court for a direction to the respondent authorities to grant him licence to run the P.D.S. shop under the Bihar Targeted Public Distribution System (Control) Order, 2016.

3. It has been submitted on behalf of the petitioner that he was earlier selected by the Selection Committee, but, later, his claim was repudiated on the ground of his not being a permanent member of the area.

4. The aforesaid assessment of the Selection Committee has been seriously challenged by the petitioner. It has further been submitted on behalf of the petitioner that the appeal which has been preferred before the District Magistrate, Araria, against the order of the Selection Committee, has yet not been disposed off.

5. After some arguments, Mr. Amarnath Singh, learned Advocate for the petitioner seeks permission to withdraw this petition in order to enable the petitioner to press the appeal already preferred by him before the Appellate Authority.

6. Permission is accorded.

7. On the presentation of the order passed by this Court, the Appellate Authority shall, after hearing the parties, perusing necessary documents and taking into account all the grounds urged in the present petition as also after hearing the private respondent No. 9 and other stakeholders, pass a reasoned order in accordance with law within a period of three months.

8. With the aforesaid observation/direction, the petition is permitted to be withdrawn.
