The petitioner seeks bail in a case registered for the offence punishable under Section 30, 30(a), 38 & 41 of the Bihar Prohibition and Excise Act, 2016.
70 liters of country made liquor and 8.640 of foreign liquor is said to have been recovered from the Honda City car and petitioner and one accused, namely, Raj Kishore Yadav alias Faujdar Yadav were apprehended in course of escaping from the said car.
It is submitted by learned counsel for the petitioner that no incriminating article has been recovered from the conscious physical possession of the petitioner. He has been
Patna High Court Cr.Misc. No.25150 of 2018 (02) dt.01-05-2018 2/ 2 falsely implicated in this case by the police while he was standing at the place of occurrence in the wait of the conveyance. He has no concern either with the seized liquor or the car in question. No more case under the Excise Act has been lodged against the petitioner. He has been languishing in custody since 05.03.2018. In the facts and circumstances of the case, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned 6thAdditional Sessions Judge, Saran in connection with Masrakh P.S. Case No. 53 of 2018.
