Petitioner seeks bail in connection with Shastri Nagar P.S. case no. 287 of 2017, registered under Sections 467, 468, 471 and 420 of the IPC The allegation precisely is that he was in the habit of issuing fake transfer certificates to be used by the offenders to claim juvenility.
Learned counsel submits that he is in custody since 25.5.2017. He has no criminal antecedents. The allegation against the petitioner would, prima facie, constitute offence under section 465 of the IPC.
Learned counsel for the State opposed the prayer and
Patna High Court Cr.Misc. No.51028 of 2017(2) dt.20-11-2017 2/2 placed the findings of the learned Court below. Having heard both the parties, the bail petition is disposed of by the following order:
Upon framing of charge or expiry of five months whichever is earlier, if the petitioner furnishes bail bond in the sum of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each, the learned Court below (Judicial Magistrate 1st Class, Patna/concerned Court) shall accept the same and release him on bail in connection with Shastri Nagar P.S. case no. 287 of 2017 to its own satisfaction subject to the condition that one of the bailors of the petitioner shall be his own/close family member.
