JUSTICE DINESH KUMAR SINGH ORAL ORDER 29-03-2016 Heard learned counsels for the petitioners and the State. The petitioners being mother and sister of the late husband of the informant are apprehending arrest in a case registered for the offences punishable under Section 498A, 302/34 of the Indian Penal Code.
The basic accusation of killing Asha Devi by throttling her neck.
It appears that the case was registered in the year 2005 and processes have been issued under Sections 82/83 of the Cr. P.C. in the year 2007.
Let the learned court below consider the prayer for regular bail of the petitioner in case the petitioners surrender
Patna High Court Cr.Misc. No.13549 of 2016 (2) dt.29-03-2016 2/2 within four weeks from today in connection with Ghorasahan (Jitna) P.S. case No. 169 of 2005 pending in the court of learned S.D.J.M., Sikrahana, Motihari. While considering the prayer for regular bail the court below shall take into account the fact that petitioners are ladies and petitioner No.2 is suffering from serious ailment.
