Petitioner seeks bail in a case registered for the offences punishable under Sections 395 of the Indian Penal Code and 27 of Arms Act.
The FIR of the occurrence of dacoity is against unknown.
Submission is that the petitioner was remanded in this case from another case on 04.08.2017 on the basis of confessional statement of co-accused before the police. The investigation of the case is already complete. However, the petitioner was never put on T.I.Parade nor anything was recovered from his possession.
Considering the aforesaid facts, let the
Patna High Court Cr.Misc. No.22886 of 2018 (2) dt.24-04-2018 petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Sessions Trial No.475 of 2017 arising out of Sasaram (M) Darigaon Police Station Case No.1352 of 2016, subject to the condition that the petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
