JUSTICE BIRENDRA KUMAR ORAL ORDER 24-04-2018 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. The petitioner is in custody in connection with Hajipur Sadar P.S. Case No. 523 of 2017, a case under Sections 363, 366(A), 372, 120(B) of the Indian Penal Code. Statement of the victim girl recorded under Section 164 Cr.P.C. would reveal that the petitioner and others kidnapped her due to land dispute between the two families. There is no further allegation.

Submission is that there is false implication just to pressurize the petitioner and others in land dispute. Considering the aforesaid fact, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like

Patna High Court Cr.Misc. No.23312 of 2018 (2) dt.24-04-2018 amount each to the satisfaction of the learned Court-below where the case is pending in connection with Hajipur Sadar Police Station Case No. 523 of 2017 with condition that the petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
