JUSTICE VINOD KUMAR SINHA ORAL ORDER 01-05-2019 This is an application for grant of anticipatory bail in connection with Piprahi P.S. Case No. 107 of 2018, disclosing offences under Section 406 read with 34 of the Indian Penal code.

Allegation as per FIR against the petitioner, who happens to be the PDS dealer that he did not deposit the amount in Nazarat against the price of the empty gunny bags. Submission of learned counsel for the petitioner is that food-grains are being supplied as per the order of the authorities concerned and the petitioner is only a PDS Dealer and he is ready to abide by any condition imposed upon him and also considering the aforesaid fact, this Court has granted anticipatory bail to the other accused persons vide order dated 02.01.2019 passed in Cr. Misc. No. 77734 of 2018 and vide

Patna High Court CR. MISC. No.14427 of 2019(3) dt.01-05-2019 2/2 order dated 30.01.2019 passed in Cr. Misc. No. 76591 of 2018. Heard learned A.P.P. also.

Having heard both sides, in view of the facts and circumstances as stated above, let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/-( Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate-1st Class, Sheohar in connection with Piprahi P.S. Case No. 107 of 2018, subject to that condition that laid down under Section 438(2) of the Code of Criminal Procedure.
