This application for regular bail arises out of Dehri (Town) P.S. Case No. 507 of 2016, for the offence punishable under Sections 272, 273 of the Indian Penal Code and Section 30/38(1)(2)/41 of Bihar Prohibition and Excise Act, 2016. The petitioner is in custody since 22.01.2020. His application for regular bail was earlier rejected by this Court by order dated 17.09.2020 passed in Cr. Misc. No. 20051 of 2020. There is allegation of recovery of 740 liters of Indian Made Foreign Liquor from a godown belonging to the petitioner during search conducted by the police. Learned counsel appearing on behalf of the petitioner has submitted that there is no likelihood of expeditious conclusion of trial in near future and the petitioner

Considering the above submission and the submission that a co-accused in similar circumstance has been allowed regular bail by this Court, this application is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District and Sessions Judge-II-cum-Special Judge, Excise Act, Rohtas at Sasaram, in Dehri (Town) P.S. Case No. 507 of 2016.
