JUSTICE DINESH KUMAR SINGH ORAL ORDER 01-05-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under sections 457 and 380 of the Indian Penal Code.
It is alleged that the head of Honda pump set of the informant was stolen on 5/6.3.2015. Subsequently, the head of the pump set was recovered from the hutment adjacent to the house of the petitioner.
It is submitted by the learned counsel for the petitioner that for the occurrence of 6.3.2015 the FIR was registered on 16.3.2015 and the recovery of the head of the pump set of Sonalika company was made whereas the theft alleged was of the head of the Honda pump set. Statement has been made in paragraph 3 of the petition that the petitioner has no criminal
Patna High Court Cr.Misc. No.20198 of 2015 (2) dt.01-05-2015 2/2 antecedent. More over, FIR itself suggests the suspicious nature of accusation.
The aforesaid facts constitute grounds for consideration of the prayer for regular bail of the petitioner by the learned court below in case the petitioner surrenders within six weeks from today in connection with Phulwariya P.S. Case No. 30 of 2015 pending in the court of learned JM Ist class, Gopalganj. This application is disposed of with the aforesaid observation/direction.
