Petitioner seeks bail in a case registered for the offences punishable under Sections 25(1-B)a/26/34 of the Arms Act.

From the house of this petitioner, a rifle was recovered by the police and for that, the petitioner as well as his full brother Bilendra Yadav have been arrayed as accused in this case. Petitioner is in custody since 19.12.2017.

Submission is that recovery is not from conscious possession because the house occupied by different members of the family.

Considering the aforesaid facts, let the

Patna High Court Cr.Misc. No.23337 of 2018 (2) dt.24-04-2018 petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Kako (Bhelawar O.P.) Police Station Case No.255 of 2017, subject to the condition that the petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
