JUSTICE VINOD KUMAR SINHA ORAL ORDER 18-06-2019 This is an application for grant of anticipatory bail in connection with Pakaridayal P.S. Case No. 04 of 2013, disclosing offences under Sections 406, 409, 420, 467, 468 of the Indian Penal Code and Section 7 of the Essential Commodities Act.

As per the F.I.R. the prosecution story is that one truck was intercepted by the police and two persons along with driver were arrested. From the truck, 967 Kg of coal was recovered and it is said that the same were taken to the Satyam Brick Industry.

Submission of the learned counsel for the petitioners is that petitioners are only partners of the Satyam Brick

Having heard both sides, considering the above submission, this application is allowed. Let the petitioners, above named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount to the satisfaction of learned Sub Divisional Judicial Magistrate, East Champaran, Motihari, in connection with Pakaridayal P.S. Case No.04 of 2013, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
