Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor appearing for the State. Petitioners apprehend their arrest in connection with Sikandra P.S. Case No. 197/2019, registered for the offences punishable under Sections 341, 448, 504, 506/34 of the Indian Penal Code and Section 27 of Arms Act. Petitioners are said to have opened fire while they were searching the informant's son.
Admittedly, none has sustained any injury and
Patna High Court CR. MISC. No.20724 of 2020(2) dt.04-11-2020 2/2 para 3 of the petition goes to show that petitioners do not have any criminal antecedent.
Learned counsel for the petitioners submits that petitioners are co-villagers of the informant and as a matter of fact, only some hot exchange of words had taken place between the parties but informant lodged the present case with exaggerated story.
Considering the aforesaid facts and circumstances as well as submissions of the parties, this anticipatory bail petition is allowed and it is ordered that petitioners, in the event of their arrest/surrender within six weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned J.M. 1st Class, Jamui in connection with Sikandra P.S. Case No. 197/2019, subject to conditions as laid down under Section 438(2) of the Cr.P.C.
