The Petitioner who is in custody seeks bail in connection with Mansi P.S. Case No. 65 of 2017 registered for the offence punishable under Sections 25(1-b)a, 26 and 35 of the Arms Act.
It has been alleged in the FIR that on 24.03.2017 at about 4:05 pm when the informant on secret information was checking the vehicles, he found two persons coming on motorcycle and after seeing the police party they started fleeing away, and after chase the police party apprehended them. During search five cartridges were recovered from the possession of the petitioner.
Patna High Court Cr.Misc. No.38904 of 2017(2) dt.19-08-2017 2/2 It has been submitted on behalf of the petitioner that the petitioner has been falsely implicated in this case. It has been further submitted that the seized motorcycle is not the stolen one as it has been taken by the owner after showing the documents. Apart from this case petitioner has not been implicated in any other case. The petitioner is in custody since, 25.03.2017.
Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Khagaria in connection with Mansi P.S.
