Mr.Renuka Ratnakar, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 20-02-2021 Heard learned counsel appearing for the petitioner and the learned A.P.P. for the State.

The petitioner apprehends his arrest in connection with Nawada P.S. Case No. 906 of 2019, registered under Sections 504, 506 and 387 of the Indian Penal Code, pending in the court of Chief Judicial Magistrate, Nawada.

The accusation is that informant, Md. Daud Khan, is the Manager of Jai Mata Di Enterprises, engaged in extracting the sand. On 02.08.2019, at about 8.20 P.M., he received a call on his mobile no. 9934440367 from mobile no. 9955640994, the caller disclosed his name as Chandan Kumar (petitioner) and started to abuse denoting his caste. Before 20 minutes, Ramdhin Yadav, Munsi of Lakhpathbigha Sand Ghat informed that Chandan Singh (petitioner) and 4 to 5 unknown had come in the office and made demand of

Patna High Court CR. MISC. No.13051 of 2020(5) dt.20-02-2021 2/2 Rs.1,00,000/- as ransom and damaged the office, they took away cash and giving threatening of dire consequences and also made firing.

Learned counsel for the petitioner submits that, in fact, petitioner had gone to purchase the sand at the Sand Ghat, where hot talk exchanged regarding the price of sand but informant with ulterior motive lodged the present case with false allegation. Further submission is that while petitioner is accused in four other cases but in all cases, he is on bail except Nagar P.S. Case No. 925 of 2019, registered for the offence punishable under Sections 147, 148, 149, 307, 323, 504 and 506 of the Indian Penal Code. Having considered the facts and circumstances of the case and the nature of allegation against the petitioner, I am not inclined to grant anticipatory bail to the petitioner. Accordingly, his prayer for grant of anticipatory bail stands rejected. The petitioner is directed to surrender before the trial court within four weeks and pray for regular bail, which would be considered by the trial court in accordance with law without being prejudiced by the order of this Court.
