The petitioner, already in custody, seeks bail in connection with S.T. No. 130 of 2017 arising out of Jagdishpur P.S. Case No. 111 of 2012 registered under Sections 307, 328 and 302 of the Indian penal Code.
Allegation in brief is that while the informant was sleeping, petitioner is said to have set fire on him as a result of which, he succumbed to injury after ten days. Submission is that only two witnesses remained to be examined i.e., Investigating Officer and doctor, and rest others have not supported the case.
Whereas learned counsel for the State submits that statement of the victim is a dying declaration and it is alleged that petitioner has killed him by setting fire on entire body. Having considered the aforesaid facts and circumstances,
Patna High Court Cr.Misc. No.24146 of 2018(2) dt.24-04-2018 2/2 presently, the prayer of bail of the petitioner is rejected and the trial court is directed to expedite the trial and conclude the same preferably within six months. If the same is not concluded within stipulated period, petitioner may renew his prayer of bail. (Arun Kumar, J) sujit/- U T
