07-05-2018 Heard Dr. Leelawati Kumari, learned counsel for the petitioner, learned Addl. Public Prosecutor as well as Mr. Md. Javed Jafar Khan, learned counsel for the informant. The sole petitioner, who is in custody only since 12-02-2018 in a case, which was registered long back in the year 2016 for the offence under Sections 323, 324, 302, 34 of the Indian Penal Code, vide Barachatti P.S. Case No. 300 of 2016, has prayed for grant of bail.
Learned counsel for the petitioner submits that in the case, except the informant and one person, no independent person has supported the prosecution case. She further submits that one of the co-accused has also been granted bail. On aforesaid ground, a prayer has been made for granting bail.
Patna High Court Cr.Misc. No.27083 of 2018(2) dt.07-05-2018 2/2 Fact remains that petitioner was arrayed as one of the accused in the F.I.R., which was lodged in the year 2016, however, the petitioner is in custody only since 12-02-2018. In the F.I.R. itself, there is specific accusation against the petitioner, in which, father of the informant was done to death and informant also received serious injury.
Considering the facts and circumstances, I do not find any ground to extend the privilege of bail.
The prayer for bail stands dismissed.
