JUSTICE SUDHIR SINGH ORAL ORDER 03-05-2016 Heard learned counsel for the petitioner and the State. The petitioner is apprehending his arrest in a case instituted under Sections 341, 323, 379, 307, 427/34 of the Indian Penal Code and 27 of the Arms Act.

Allegation against the petitioner is that he along with other accused persons came at the house of the informant, attempted to outrage modesty of the sister of the informant, assaulted with various weapons upon the informant and his brother and took away valuable articles and money from the house. It is submitted on behalf of the petitioner that he has got no criminal antecedent. He has falsely been implicated in the present case. From perusal of the injury report it is evident that the nature of injury is simple. Hence, no offence under Section 307 of the Indian Penal Code is made out.

On behalf of the State, it is submitted that petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the above named petitioner, in the event of arrest or surrender in the court below within a period of six weeks, be released on bail on

Patna High Court Cr.Misc. No.15666 of 2016 (2) dt.03-05-2016 2/2 furnishing bail bond of Rs. 10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Lakhisarai, in connection with Barahia P.S.
