Petitioner apprehends arrest in a case registered for the offence punishable under sections 467/ 468/ 471/ 419/ 420/ 120 (B) of the Indian Penal Code.

As per F.I.R., on the basis of false transfer certificates of students, this petitioner alongwith other co-accused persons got the admission of students in the school and facilitated the students to appear in Annual Secondary Examination, 2014. It is submitted that the petitioner was working as Assistant Teacher in Mathematics who retired on 30th June

No.15531 of 2023(2) dt.18-05-2023 2/3 2021 and did not do any work of admission of students during April/May 2012 as a result of which no signature of the petitioner was present in the admission register. Instead, the name of the principal Lalan Prasad Singh and the signature of the admission clerk were mentioned in the admission register of the concerned school. Only on the the basis of suspicion this petitioner has been made accused in this case. It is further submitted that from the perusal of the FIR and enclosures, it is clear that according to the statement of the informant and further verification of the documents, there is no involvement of this petitioner in the alleged incident. Petitioner claims clean antecedent.

Learned counsel for the State opposes the bail petition of the petitioner.

Considering the aforesaid facts and circumstances of the case, in the event of arrest or surrender within six weeks from today, let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned Court of A.C.J.M-II, Madhepura or the learned concerned court in connection with Gamhariya P.S. case no 206 of 2013, subject to the conditions laid down under section
